package XML two menu entries with same name?

Let's say I wanted to add a menu entry under VPN and under Status named "My VPN"

<menu>
    <name>My VPN</name>
    <section>VPN</section>
    <url>/myvpn/vpn_myvpn.php</url>
<menu>
<menu>
    <name>My VPN</name>
    <section>Status</section>
    <url>/myvpn/status_myvpn.php</url>
</menu>

The above doesn't work. This will only work if the menu names are unique. Is this expected behavior?
